“I Think I Have a Claim… Now What?”

No one wants a bar complaint or a malpractice claim on their record. It happens. And what happens next can be equally troublesome if you don’t know what to do or behave badly out of frustration, panic or ignorance.
If you think you have a claim or a potential claim, report the issue immediately to your carrier. Don’t discuss your malpractice coverage or liability with the claimant. Don’t refer the claimant to your malpractice carrier.
If a suit is brought against you, you must notify your malpractice carrier immediately. Failure to give timely notice could result in denial of coverage – leaving you responsible for resolving the matter on your own.
Your carrier can make sure you’re covered and may even help you repair the incident before it becomes a claim.
